Querist : Anonymous (Querist) 17 September 2010 This query is : Resolved 
one of my distant friend proposed to sell his land so i accepted his proposal and the amount was fixed for Seven lakh and i paid him Rs three lakh as an advance and the sale deed was signed. after that i put my own money to leveled the land and made it fit for living and on geting time i went to registerer office to registere the sale deed there i came to know that the plot of land was not his private land but a government land occupied by him and which was not alloted for his use so i asked him to returned my advance money but now for the last two month he not returning my money. what should i do to get back my money
1.should i file a civil suit or a criminal case
2.can i initiate both at a same time
i want my money back and i also want to punish him for this act
please suggest

Yes, you can file both criminal and civil case.

By his representations you are made to pat with your money and hence he is punishable under 420 IPC. Receovery under Civil side is also available.
