This query is : Resolved
The apex court had come heavily on builders who make monitory benefit of open/covered spaces in ground floor by selling/renting after completing construction of multi story building. I have given reference of the case in an earlier query In our complex the Association of owners are availing such monitory benefit renting out some open spaces. Can registrar of societies with whom the association is registered can interfere in this matter or only judiciary can?

Registrar has no role to play in the given facts. The best remedy is only to approach legal machinery.

The Registrar's powers are very limited and it does not extend to dealing with cases of encroachment and all. You have to approach only a court of law for remedy in such matters.

You should approach the court of law.
