In case there is no clause to terminate the lease in the lease deed, can one terminate the lease by using the provisions of Transfer of Property Act.

Dear Mr. Kotresh, Yes, even if there is no termination clausein the lease deed, it could be terminated under the provisions of ToP. THERE are some duties and liabilities for lessor and leesee both under the Act and if they dont comply with the same or they breach the contract, the termination process can be initiated.

Sir first you have to issue a notice as stipulated under TP Act determining the lease.

Yes you can issue notice under section 106 of tp act. see new amendments.
