Further details are required to be studied before advising on the matter. The Hindu Succession (Amendment) Act, 2005 does not apply when the property was thrown open for partition before 09.09.2005. If there is a partition taken before 24.12.2005 then such a partition is protected. Provisions of law earlier to the Amendment Act, varies from state to state depending upon the amendment made to Section 6 of the Hindu Succession Act by each state. Better you furnish full details.
