Registration of gift deed

(Querist) 14 January 2025 This query is : Resolved
Donar serving jail term wants to register at the subregistrar office gift deed pertaining to unmovable property in favour of his wife. Query what is the procedure (gift deed was made prior to going to jail.)
Quick Summary
This discussion clarifies the process for a donor currently in jail to register a gift deed for immovable property in favour of his wife. Key points include the procedure for executing the deed from prison, with the Sub-Registrar attending the jail. It also addresses situations where the initial execution period has lapsed, requiring a fresh deed, and confirms the validity of the expert advice provided.

kavksatyanarayana (Expert) 14 January 2025
If the period of execution of the Gift deed lapses by 8 months (the normal time is 4 months and with a penalty of 4 months), he shall execute/make a fresh gift deed. The Sub Registrar will attend to Jail for admission of the document. Still, the person in Jail after obtaining permission from the Jailer shall request the Sub Registrar to attend to jail and admit his execution through the Jailer.
