Ancestral property

Dear Sir,

Iam velmurugan from tamilnadu. My grandfather has two acres land and he died in 1960. My father has two siblings 1 elder brother (who has died 3 years before) and 1 elder sister.

Is it possible to make the 2 acres registered on me since the patta is in my fathers name for 25 years.

According to Hindu succession Act your father,your uncle's legal heirs and your aunt have equal right over the property. If they would agree and transfer their share to you by a registered deed then you can become absolute owner.Erroneous record in Land Revenue Dept.or Panchayat/Municipality is not factor to determination of ownership.

The land in the name of your grandfather would be inherited by all his legal heirs, if he expired intestate.
You can not become owner of full property of your grandfather.

Well advised by experts, the legal heirs of your deceased paternal uncle and your father's sister have to execute a registered release deed relinquishing their rights to your father after which he can execute a gift deed in your favor to make you the owner of the property. Patta on your father's name shall not confer title to him.
