Mortgage of leased property

(Querist) 06 September 2013 This query is : Resolved 
sir, i want to ask that if lease deed do not expressly prohibits lessee from mortgaging the leased property for taking loan during thr term of lease ,instead it declares that all the rights and liabilities of lessor and lessee shall be as set forth in section 108 of transfer of property act, then how sec 108(j) will help lessee as the bank lawyer want the lease to specifically mention mortgage right given by lessor to lessee.
