Dear Sir
In may 2012 I filed a case of divorce in the court and my ground is desertion and cruelty. After filing the case of sec.9 in 2009 I got the decree in 2010 and after completion of year and 7 months i filed petition for divorce. Now my ex wife is claiming that she hasn't received the notices although the addresses are same both in sec.9 petition and in divorce petition. Even paper publication 5 notices has been sent to her permanent adress now she is claiming that. Now her advocate has filed a petition for maintenance. (I know I have to give).In their petition they have written that my salary is 50 thousand but my actual salary is 20 thousand out of which my basic salary is 18k ( i can produce salary certificate). Kindly suggest me:
a)How much amount I will have to give her for monthly expenses.
b) Whether my sec.9 decree will not have importance? If it gets dismissed can file a petition in High court.
c) Both of us are leaving separately for 4 years so how much time it will take for getting divorce?
d) My parents age is above 70 years and my mother cant do daily household activities so whether court will not consider it ?
e) How can i prove that my sec. 9 notice has not been taken by them intentionally? Although they had there tenant in that duration. Court has directed his clerks to produce the Taamila.
f) How much time it will take for divorce?

Yes the maintenance is according to the real income of you, dont worry about their counsel's petition. the court will take the real with full confirmation
Ask your lawyer to add all the details about your aged parents,
If mutual consent then with in a year you can, but if your wife is like to delay then it will take little more time.
