Adjustment of Rent...

I was supplied water and electricity by my landlord always for which i have paid him by cheques though the same is not mentioned in our Rent Agreement .
Three years back my landlord asked me to make the payments for Water and Electricity Expenses which had been accumulated for a year as he had not made such payments.
I duly made the payment and after 6 months as he was not giving me receipt for such a payment of advance rent, i sent him a legal notice which he duly accepted but never replied to .
Now my land lord has filed a case against me for eviction for non payment of rent for more then 2 years but my argument is that i have paid advance rent to him in shape of payment to the Water Department etc and also sent a legal notice to the same which you have received .

What chance do i have in this case .

Obliged if any case law is also quoted .

Your stated details are irrelevant to your case. Just clear something.. Whats about your building purpose, thats residential or commercial? Is any agreement in force? Is he sent any prior notice for claim the arrears of the rent? Whether you paid the rental or not?

If your landlord proved that building's need for his own use mean he can succeed his case. Unless you have good merits. But his grounds on arrears of the rent only. If you are genuine mean you can succeed.

The rent agreement for property is commercial purpose ...
The landlord says he sent the notice in his pleadings but i never received it and he has no proof to the same and his so called alleged notice was sent after my notice for receipt of advance rent paid ...
The case of the landlord is not related to bonafide purpose but only relating to non payment of rent ...
i am depositing the rent in court asas court as directed me now ...
