No it is not applicable. for which separate petition has to filed before the court.

Dear AF,

Please recheck if there is any sec. 41a of CrPC? If you are talking about sec. 41(1)(a), in what way you would like to link your query of non-payment of charges with arrest of a person by any police officer without an order from a Magistrate and without a warrant?

Dear All thanks for your respones

My client[first party] is unemployed [lost his job] after a POLICE went to his Office to take hime to the station.

Later the other paryt[wife side] got exparte on her favour for maintenance suit.

The first party cant pay any amount.

The other party are ready to file executive petition

The First party is worried
