Respected all Experts/Members,
I am facing problem in finding a way in one case i request all of you to help and give me right guidance to solve the problem. My query is as follows:-
My company is a manufacturing company of the prepaid recharge card of BSNL,IDEA, RELINCE, AIRCEL,Etc and Labels of various companies like Indian Oil Corporation, Vankeys,ETC. situated at Pune (Maharashtra), my marketing persons are facing problem to get orders from local companies due to Octroi. For us a manufacturing cost of a card is of Rs 0.45 (i.e. 45 paisa) on which the MRP is printed as Rs.100/- now when we take the orders of the local telecom companies Octroi people are obstructing us an telling us to pay octroi tax on the MRP and not on Invoice amount. which is not at all possible because the manufacturing cost of one order is of Rs.1,00,000/- then the Octroi tax is of Rs.4,00,000/- . If we oppose the Octroi people then they seize our goods and our client will be in trouble and our business too. Now my management had asked me to find a way so that we can get local orders also.
Please help me n tell me how to solve this problem. I came to know that some telecom companies filed a writ petition for similar facts please any of one member can give me such citation. please suggest me how to find solution to whom i should meet ( Concerned authority) and tell them? This is injustice on companies because they can not get the business from local. Please show me right path so that i can find a way to solve this problem.

Dear 'Your Advocate', I think your solution is worst than the disease. I think you have not even understood the issue. The product is owned by the Telecom Companies and not by the querist. The querist is only a manufacturer and for manufacturing they are raising invoice. The MRP is that of the Telecom Company and not that of the Querist. Therefore, the querist by no means has any authority to alter the MRP (either lowering or increasing).
If that was possible, the querist would not be posting the query in this forum at all.
