i got married 2005.my wife file a case 498a against me and my family member in 2008. she file case for maintenance Feb-2010.i working in a privet transport company my salary is below 4000/- at chattisgarh.my wife is working as manager in a company at Hyderabad leave with parents.salary about 15000/-.my daughter is four years old .i want to know what amount can be fixed by court as maintenance.

if you able to prove the salary of your wife, she will not get anything from you as maintenance. Section 125 cr.p.c provided for a wife, children or parents who are not capable of maintain themselves. If they are capable of maintain themselves they are not entitle for maintenance

I agree with Sanjeev, in case, you can prove, you can escape from maintenance to your wife but you have to pay maintenance to your daughter but within your capacity.
