Regarding Monthly Salary

(Querist) 16 February 2011 This query is : Resolved
Sir,

Currently I am working in School. In school the salary is on monthly salary basis. The monthly salary was calculated as per the total day of every month. So we requested you to please give me the actual calculation of the salary as per labour rules. If in february month the salary should be given for 28 days or for 30 days. Please explain me all rules and also calculation. So I can submitted to my school as soon as possible.

Monthly salary includes the weekly off. Thus total salary of a month is considered to be paid in 26 days considering a full month under the labour laws.

Dear Smitha,
A "month" according to Section 3 of General Clauses Act, 1857 means a british calendar month.
Thus, even though the month of February may be having 28 or 29 days, still it will be called a month and one is entitled to full salary for a month and the salary would not be restricted to 28 days or 29 days.
I really do not know what exactly is your problem?

If the salary is for a month, the salary has to be paid in full irrespective of the working days or calender days.
