Land Acquisition

(Querist) 11 January 2011 This query is : Resolved
This is regarding my land in Chandigarh which was acquired. Section 4 was published in 2002, Section 6 in 2003 and award in 2005. Chandigarh administration took possession of our land in 2005 and we immediately filed reference which came up for hearing in late 2005. We completed the evidence and closed it in Jan 2007 and the judge even heard the arguements. But since then 3 judges have changed and we still do not have a judgement from reference court. Almost 4 years have passed since we completed the evidence, what recourse do we have now to get the judgement ?

file a writ before the high court or lodge complaint to the Registrar of Vigilence of High Court.

You can file an application for early disposal before the same court. If it is not positively responded, you can apporach the high court under Art,227.
Kirti Kar Tripathi (Expert) 12 January 2011
YOU CAN SEEK DIRECTIONS FROM HIGH COURT BY FILING A WRIT OF MANDAMUS COMMANDING THE LOWER COURT TO DISPOSE THE CASE WITHIN REASONABLE PERIOD.
