About "u.p.-adhivakta kalyan nidhi nyasi samiti"

Dear Sir,

My father was an advocate, he passed away by 3rd November 2009 due to heart attack. he was 62 years old.

he had joined the "u.p.-adhivakta kalyan nidhi nyasi samiti" by year 2008 through the plan of 500rs annual.
for this he paid 500rs in the year 2008 and after that he wasn't paid the amount of rs 500 for the year 2009,( may be he could had paid if it won;t happen by November)

we had collected the documents and made the affidavit for this purpose and send it to lucknow nyasi samiti.
after some time we received a check of rs 40000/- while it was written in the proposal of "u.p.-adhivakta kalyan nidhi nyasi samiti" that in case of any tragedy they will pay an amount of rs 5Lacks to the dependent of family of advocate.

I also heard that Bar Council of U.P. will pay some amount on the sudden death of an advocate, but when i send them the documents they refuse to pay the amount.

Being a member of your Advocate family Sir i am requesting you to please help me.
I have 2 sisters after me to marry them.

Read carefully the proposal of Nyasi Samiti. If really there is such proposal you can approach to consumer forum or civil court.

sir in the proposal they had mentioned that either 5000rs for one time payment or 500rs annual for 10 years.
so he joined as 500rs annual.

Actually i don't have the proposal document.
my father had told me once about the benefits of "nyasi samiti".

so if anyone could please help me finding the fact and exact things behind that , i be very much thankful.

You cannot act on hearsay. Try to get at the proposal document and go through it. Then only you can decide the future course of action in this regard.

1. My father also died 'the same' way as your & my father in year of 2009 and I also get the same amount as you got. There is no explicit statement written on the filling form of Kalyan Nidhi Samiti that you or I got Rs 5 Lakhs in case of accidental death. Because I have a copy of my father form which I filled for my father and the same also for me when I become member of Kalyan Samiti.

2. You can only claim Medical reimbursement if you father was ill and you need urgent aid before death, but not after his unfortunate death.

3. CHeck you Local Bar of your father became member when he was practising that providing any legal aid in the name of your mother, most bar provides assistance to the widow of an advocate.

btw i am quit satisfied with your answer but just need a copy if it is possible for you to arrange, i be very much obliged to you for that.
