Transfers By Way Of Pick & Choose Method

Dear Sir/Madam
I am working in Regional Rural Bank Working As Cashier cum clerk & belong to that union not liked by management.Managament have adopted a transfer policy endorsed by both unions.but unfortunately management is victimising the persons belonging to a particular union and transfer the persons at their will by way of pick and choose method.Is not there any legal remidy to stop the management to favour one union and victimise the other,in my case I am expert in computer software but management transfered me to that branch where banking is done manually.hence I feel Victimised.

You can file writ petition before high court.

In your case, first of all you have to obtain the transfer policy of the bank under RTI. Thereafter, you have to verify the transfer policy. Thereafter, if you find out that the management has transfered you against the transfer policy, you can file Writ petition against your transfer. However, in the transfer policy you cannot claim the non transfer as a matter of right.

Transfer of an employee is the right of the management, who is the best judge to decide where the services of a particular employee can be utilised. Normally the courts do not interfere with the transfer of an employee unless there exists any malafide of victmisation. in your case, you have been appointed as Cashier cum clerk, therefore the management can transfer you any where on the post of Cashier cum clerk. your specialization in computer has no role in management right and power.
