Salary Cheaque Bounced

Hi

I was working with a consultancy and left it on 26th April,2010. My employer provided my salaried cheaque for april month with date mentioned as 9th June,2010.
But he asked me to deposit same on 8th July,2010 as he was having shortage to funds. I deposited my cheaque on 8th July but it got bounced and he is not providing my salary
Kindly guide me what action I can take against him.

Get your lawyer to issue a notice [it is mandatory to issue a notice] without wasting more time. Then go for a complaint.

IT IS A SALARY CHEQUE WHICH IS DISHONOURED.

YOU MAY SEND A LEGAL NOTICE AND DEMAND THE SALARY .SEND IT BY SPEED POST A.D. /REGD POST A.D.IN CASE SALARY IS NOT PAID YOU HAVE TWO OPTIONS .
1.YOU MAY FILE A CRIMINAL CASE UNDER SEC.138 OF N.I.ACT FOR DISHONOUR OF CHEQUE.
2.YOU MAY FILE AN APPLICATION IF YOU WERE WORKING AS LABOUR/STAFF TO THE LABOUR COURT IN THE AREA FOR PAYMENT OF SALARY AND COMPENSATION AND COST.
3.YOU MAY FILE A CIVIL SUIT IN CIVIL COURTS /WRIT PETITION TO HC, IN CASE YOU ARE IN THE OFFICER CATEGORY.

Since it is salary cheque instead of all other hassels go to the Labour officer, he will force the employer to pay up.

Hello

I thank you all for such a good response. My ex-employer called me last week and is asking for one week time. Will it be good if I provide him 1 more week time or not?

Kindly help me by mentioning which documents I should have with me in case to issue a notice or file a case against him.
