Hello,
My Co-Op Housing society is in Pune. I am committee member since last 3 years. Our chairman is a defaulter in paying maintenance charges, and he does not atttend meetings. 3 months back managing committee asked me to become chairman. Without Chairman's resignation, I started working as Chairman. We had sent him minutes of the meeting where it said he is no more chairman.
Now, he came back, and changed the minutes book. He claimed back as Chairman. In AGM yesterday, he remained absent and I was again asked unanimuusly to become Chairman henceforth.
Without actual resignation, is that legal for me to continue as Chairman (as it is passed in AGM)?

1. AGM cannot appoint chairman of the MC. Only the MC can appoint chairman. Hence nobody else can mis-represent as a Chairman.
2. Without resignation and required formalities, Chairman will remain chairman, till the coop. registrar passes appropriate orders on a complaint by the MC or a ordinary member.

Your Committee meeting should have passed resolution that chairman is in default & absent consecutively for 3 meetings and that report should have approval of Registrar for change of Chairman .

chairman is elected by the MC members and not by the AGM.

Thank you all for quick help. This is resolved now.
