divorce

Querist : Anonymous (Querist) 03 June 2010 This query is : Resolved
hi friends,

recently we have filed a case of mutual divorce...
under this there are certain clauses:
1. we have exchanged all the things and nothing is left to be claimed as there are no liabilities left on each other.
2. as this case is filed on mutual understanding between the two parties, none of the parties will file any case against each other, in future.

Queries are:

even after these clauses are included in the mutual divorce, is there a possibility
1. to claim anything from the other party, as my -in laws are claiming now, after the case has been filed
2. can any of the two parties file any FIR on each other
3. the court has asked us to come after six months, what if one of us didn't turn up

1.They want to go back from mutual consent and hence are claiming some thing from other party.

2. Yes. There is no bar to file FIR.

3. If one does not turn up after six months, the court tries to ascertains the reasons for absence and in the absence of one party, the mutual consent divorce petition will be dismissed.

thank you for your valuable advice, sir.

i need to know one more thing that if mutual consent divorce petition will be dismissed, is there any other way to get divorce or can we, later, file divorce on cruelty basis?
1. if yes, then what is the procedure?
2. if no, then what else can be done?

regards
