Maintenance for unsold flat by the Promoter/builder

Ours is a 20yrs old building. Society was formed in 1999. Builder has a Flat that is unsold till date. We have approached the builder for clearing the maintenance dues of the same. He says that unsold flats of builders are not applicable for maintenance charges. Kindly advice if it is true? If not how do we recover the maintenance charges for the same.

Does the Society's bye-laws has any such clause?

Was the flat utilized for residential/commercial use by the Builder?
If it is so, pass a resolution to the effect of collecting the maintenance dues from the Builder.
