in a civil suit for partition of property within the family a suit for partition was filled on which plaintiff paid the fixed court fee for the court jurisdiction at 2 crore rupees by now the market value of the suit property is more than 40 crores so the plaintiff get the share out of 2 crore or the actual market value i.e 40 crores , can the plaintiff demand the release deed of his share if he doesn't want the cash he just want thge possession of his share , as there are chance of manipulation of the proper market value of the property for partition as the sale deed show the less amount received as legal money but the actual money received is the black money or illegal money which doesnt have any record as evidence does the circle rate help in any way in such cases to save property from under value to save property tax and show the lesser amount deal for the property, any other help for how to value property properly at market value to save them from defendants with wrong intentions and to make proper justice to plaintiff

Circle rate may ensure minimum THAT MUCH though the actual value may still be more;
Claiming share in property would be beneficial than to settle for arbitrary value on partition !
You may opt before Court accordingly !

thanks for the reply Mr singal but i also want to know that if its for the value on partition will i get on 2 crore on which i paid the fixed court fee or the market or circle rate ie around 40 crore
