Dear Mr. Ravindra D.Tribhuvan,
1. You will first need to purchase a non judiciary stamp paper of Rs. 100.00 value in the name of any one of the legal heirs.
2. On that you will need to cite a diagram of a lineal family chart in descending order showing the names of the earliest family male member's and below that the names of his legal heirs in descending order of right up to the names of the existing living descendants which would denote a picture of the family charts of the heir ship of the intestate.
3. This document is then needed to be notarized. This affidavit then is attested by an Executive Magistrate and such deed then gets the title of a legal heir ship certificate.
4. At the second step, you will need to file a civil suit u/s 218 of the Indian Succession Act, 1925 before the court of District Civil Judge, under whose jurisdiction such property if located - seeking letter of administration of the estate of the intestate in favor of either one of such legal heirs or a group of two persons. You will need to attach such legal heir ship certificate as mentioned above with such plaint.
5. You will of course need the assistance of a local advocate who has his office in your neighborhood for such purpose.
6. The time duration for getting such a certificate desired by you from the date of its filing the civil suit would consume at least ten hearings spread over an interval of one month form each date of hearing. Moreover the efforts of your advocate can expedite the proceedings.
7. If need more clarification please do talk to this layer but then the phone consultation would be charges able as it would amount to private consultation.
