Diversion of post along with incumbent

A post is diverted along with incumbent from Station 'A' to station 'B'. After two years the same post is diverted along with same incumbent to station 'A'. Again after some period the same post is diverted along with the same incumbent to station 'B'. In the entire service the incumbent had not faced any allegations or pending any allegations. This is a state Government Undertaking. The employee is given very good / outstanding grade in the AARs for all these years. The employee is feeling insulted for being diverted the same post along with him time and again. Any remedy for this?

There is nothing to be felt insulted in this arrangement.
One should understand that without a particular sanctioned post, the Government servant cannot work. If at a particular station, city, a post is not there, then it is the usual practice of the Government/Department to divert the sanctioned post temporarily to the needed city/town, and post a personnel against that diverted post. Similarly, whenever the person has to be brought back or transferred to another place, if the sanctioned post is not there then as already indicated the post has to be diverted/transferred and the person has to be transferred. This is a very normal and usual practice.
Assume that the Government wants to utilise your services at particular station and therefore it transfers you to that place. Whether the posts are being diverted or transferred to that place is the administrative necessity and their botheration. Therefore, transferability is the condition of service of any government servant. One cannot have a grouse against that unless only you are being singled out for such a treatment while others similarly placed like you are not being touched or disturbed for long durations.
The very fact that you are getting very good/outstanding AARs itself is a proof that the Department/Government does not treat you badly. It is in your mind that you are being treated shabbily. Please do not entertain such feelings which are totally unfounded - unless as I said earlier you are being singled out for such frequent transfers - while similarly placed persons are spared.

I agree with the opinion of Shri Ramachandran.
However, opportunity may not be lost to encash instances of such diversion of posts through AAR of the incumbent to prove that he was transferred along with post to clear the mess of that office, which he successfully accomplished, as a confident and capable soldier of the management. Management may refrain from making adverse remarks even if would have any bias against the employee.

Respected experts Ramachanadran Sir and Dhingra Sir,
The same post along with the same incumbent is diverted from HQs to branch, again diverted to branch to HQs and once again HQs to branch. Due to bias only this was done. Hence, I think, it amounts to harassment. Kindly suggest any legal solution.

I think it will be very difficult for you to prove any bias. If that had been so, then you would not have been getting very good Annual Appraisals. I do not say that you may not have strong reasons for feeling so. But for that you have to bring on the table lot of information so that after going through one can have a definite say.

Dear Ramachandran Sir,
Yes it is a fact that the Reporting officer has given all 'A' grade reports ('A' means in our organisation 81% and above). Throughout my career around 28 years of service as public servant I got 'A' grade with minimum of 90% marks. I joined the organisation as LDC and I got all 5 promotions on out of turn basis by virtue of merit (i.e, the condition is that one should an average of 90% and above during the preceding 5 years Appraisal reports. Due to these out of turn promotions some of my colleagues are jealous about me. I am a sincere, honest, having highest integrity and above all I am straight forward. I do not bend if my higher officers asked me to move away from the rules and I do not write the note files as per their likes. Due to this reason I was transferred from Head Office and posted at the branch office and given a little bit work with an intention of teasing me and harassing me. Some of my colleagues on whom I have superseded due to out of turn promotion are hurling some nasty words towards me by taking advantage of the situation. I am not able to bear this. I am going through mental agony. I am thinking that the straightforward nature may not suit in these days of circumstances.
In the light of the above circumstances, I want to prove a point to the management.
I am requesting Ramachandran Sir to suggest me I points are required to be placed on table to defend my case legally.

There is nothing for you to defend or to offend. The particulars narrated by you are not enough for you to take any action. My since suggestion (I would never call it an advice) to you would be to endure all these - so long as you are doing your duty sincerely and with dedication you should not mind about what others say for you have no wherewithal to shut anybody's mouth - and continue to put in your best efforts. By your experience your shoulders should be now strong enough to shrug off all these things. If you still feel unbearable to continue in service, then since you might have already become eligible for full pension, you should put in your papers and move ahead. Any other action would backfire on you.
