Land Acquisition Act

Dear All,

The government has taken a plot under the land acquisition act and has paid a compensation, however, for the past 10 to 15 yrs the said land tax bills and other related bills still are standing in our name.

We need the land to develop it.Can we use the land as the government has not utilised it for long and there are chances of it being encroached.

Please help. Whom do we approach. The land is situated in Mumbai.

Thank you in advance. However, if the experts think it is a repetition, please note that I have not come across such a query before.

Dear All,

If your land stands acquired and you have recieved compensation then it is unlawful on your part to use and occupy the same. In so far the issue of ourstanding bills is concerned you may put forth the same to the authorities in writing clarifying the factual status.

The land is not being utilised by us. Recently it was drawn to our attention by a third party who approached us to purchase the land saying that the government documents still stand in our name. It is at that time we realised of it.

My query is whether we can approach the government and ask for the land to be returned.
Is there a provision in the Land Acquisition Act which says that if the land is not utilised for the public within a time span, it gets transferred back to the Owner.

Surely we will pay off the land tax arrears.

If not then what steps to be taken for name to be changed. For if any thing happens, we are shown as Owners of the Land.

After the acquisition, there are procedures form notice and declaration.

Check whether declaration is made or not. If not, challenge the same by filing a Writ petition
