My late brother was working in an MNC Gurgaon. He was died in an accident. Group insurance claims and other amounts are due at his company. Now his company have transferred some due amounts in his salary account by mistake. But it's not a feasible process to transact the amount in deceased a/c, since none of his family member can transact the amount from his a/c. So I have requested deceased's company to revert back this amount from his salary a/c (its a corporate a/c) and should pay to nominee (his mother) only by cheque. But his company denied to revert back the amount. Now what actions should we take against his company? Please help me.

File a criminal case under section 406 of ipc against the company.

the company is wrong in refusing to transfer the amount as per your request. you issue a legal notice to the company insisting on your demand for transfer.depite this ,if they do not do itfile a suit for mandatory injunction against the company in a civil court for this remedy.

Who are the legal heirs of your brother ?. From your statement, it appears that your brother was a bachelor.Please apply for legal heirs certificate in the name of your mother and claim the money from the company. On the other hand, if your brother had nominated your mother to receive the money, please approach civil court for redressal of the grievance. If any provident fund amount is due, your mother can file a complaint before the consumer forum.
