Dear all,
actually my query is regarding a will.actually the matter is that a will was prepared in Aug 1997 and death of testator was on sept-1997(health condition was not very good) from 1997 this will has not been in the effect or not shown any one till 2008. how we can challenge this will and how can we put it in under doubt in court.is it possible or not?if possible pl provide me any previous judgment regarding this or any act to refer this mater.pl reply soon.

You have not mentioned the date of death of the testator which is relevant. Your relationship with the testator and the circumstances under which this was done.Challenging the will is based purely on the circumstances and facts.

The will was prepared on aug-1997 and date of death is sept-1997 health condition was not very good.I only need to know if will was not got in effect up to 2008 then can we challenge it?? pl let me know is it possible?? if yes then how any act or dhara pl reply..

If the application for probate is filed in the court,you can resist it.You may also write to the concerned authorities,i.e.bank,revenue authority,municipality,pamnchayat wherever the property situated not to mutuate the property in the name etc.Whether on the basis of the will,the party concerned has executed it? if not,you can object it as and when you came to know about it.
