Hello sir/madam -
We are looking to buy a plot in chennai and when we went for a legal opinion with all the documents our lawyer said that the boundaries have been wrongly entered and they told to get a thiruthal pathiram.. but when we said that to our seller he is not willing to do that and he is saying he will provide a POA by authorizing someone to complete the neccesary steps.. Is that ok if the person authorized does all these things and will there be any problem in getting the loan as we are going to approach a bank loan for buying this property and will there be any other problems in future because of this case..

The advice of your lawyer is correct.'thiruthal pathiram' that is to say a rectification deed, correctly stating the boundaries of property sold between your seller and his seller is required and to get it done with your seller's seller a registered POA can be appointed authorizing him to carry out required rectification deed with his seller and also to execute a sale deed in your favor on his behalf.

Sir - If there is a problem in finding out my seller's seller.. what can we do now? because my seller has bought this property before ten years..

For your last query, if the previous seller is not traceable, it is advisable to go for a 'vilambugai pathiram' 'Declaration Deed'. State the relevant facts (like non-traceability of previous seller, etc.,). It is as good as 'Rectification Deed'.

Actually my seller's seller is not alive now and his only son has settled down in foreign it seems and they have selled this property to my seller in 1967 .. so what can we do now? is there any other way to get the (rectification deed) thiruthal pathiram? or as said by siva sir is that enough if we get declaration deed ?
