Lok adalat - approach for settlement for excess bill amount issue

(Querist) 19 October 2011 This query is : Resolved
I am having a dispute on a excess mobile bill. But provider party is not agreeing.

Today, they might file a case in LokAdalat. I am ready to face but I have some concerns:

1. How will LokAdalat send notice to me?

2. I will be out of state from tomorrow for 2 weeks. I will not be able to receive any letter, so what if they send a letter to my place and I read after 2 weeks? Will it be used against me?

3. How many times they send notice to present to the court? Is this all done by paperwork? or any electronic communication media involved in like, email/phone?

Please help me with the above queries.
This issue is torturing me a lot. I want to finish it at the earliest.

Appreciate your early response. Thanks in advance.

is your case pending in court?

then only if both parties agree case would be referred to lok adalat . consent of parties is must .

1.Through registered post.
2.No
3.It depends upon the will of the mobile company. Once you fail to appear that case is over.

If you want to finish it at the earliest then appear and reach to a settlement.

Dear Rohit,

In lok adalats, almost all the cases are settled in single sitting on presentation of facts by both the parties, unless some more information of vital type is needed from the concerned service provider.

However, lok adalats do not sit all the days of a month/week. It is a casual affair. They sit on some pre-appointed date and time and the venue for which the aggrieved party is duly informed well before time.

The cases are not decided in the absence of the concerned party.

So, if you have some definite information of the date and venue of lok adalat, you can send a letter to show your inability to appear before that on the appointed date due to the reasons of your being away and ask for the postponement.

In case date and venue not yet fixed, you can send necessary information to the coordinator and in-charge of the unit of the concerned department dealing with the lok adalat cases.

Dear Sankar narayanan,

As per the query, the case does not relate to banking service, but to dispute about telecom services,
Rohit (Querist) 19 October 2011
Thanks for replies, these are helpful.

Just to clarify, till now none of the parties has filed the case. But today I got communication from company that they will be filing a case in lokadalat.
Hence, there is no coordinator available yet.

So, if they file case today, in general, when will I receive the notice to present myself to the lokadalat.

Mr. Sankar, as you said, if I fail to present myself in the first notice itself, the case will be over in favour of the other party. Does that mean that they can legally force me to pay them? Or what will be effect?

Yes, the dispute is related to telecom services.

What is the difference between lokadalat and "private lokadalat"? Are they biased/managed by company?
