Removal of services of Outsourcing Persons

I am working in the State Govt. Department since 11 years on outsourcing, i am studying in Degree Final year, is it possible to discontinue my services taking into consideration of my educational qualification and Rule of Reservation.

At the time of appointing me no specific guidelines, qualifications were furnised for recruitment of outsourcing persons. Now they have prepared the guidelines and were recruiting as per the guidelines due to which we some of the outsourced candidates are being to be terminated from their services.

Kindly suggest me a way to retain my job.

Outsourcing itself states that you cannot claim permanency in job as they take people on contract basis. as per the guidelines if you fit the case you have an oppourtunity. still rules and guidelines have to be studied as you have completed 11 years of service. it depends upon the guidelines of service in that dept. which state do you belong to?

As suggested by Mr.Rajkumarlaaxman you can not claim for permanency of your job. Yes. Government has issued orders even for recruitment of outsourcing employees, certain guidelines were issued viz. qualifications etc. and also ROR should be followed.

It depends on the rules and policy of the employer. long continuance can not be regarded as valid ground for permanency. However, if any scheme of policy exists, the employee can take benefit of that policy or scheme.

Outsourced services are of the nature of contract "hire to work" and not employment. Such contract is subject to the agreement entered in to by both the parties. If no formal agreement is entered, the contract can be terminated at any time either on completion of job or on unsatisfactory service.
