Tarzan's author passed away in 1950..so copyright expired..but TARZAN name is patented/trade marked by burooughs inc. can anyone publish the novel despite the patent?

patent is not granted to litrary works..word TARZAN trademarked by company to distinguish its services /product ..kindley post ur querry in proper manner along with ur expectation in th advice..
