Identification Proof from Seller of Flat

Dear Sir/s,

Can the Managing Committee of Registered Co-operative Housing Society ask for a Photo Identification Proof from the seller of the Flat? What is the remedy if the Seller have Identification Proof with different name than the name registered with the Society?

Dear Anonymous,

The affairs of a Society are governed as per its rules and bye laws, articles 0f association. There is no bar if the society asks for the identification proof. If there is a change of name the same can be clarified by the seller.

the purpose of demanding "photo identity proof" is to find out that the seller is the real genuine person on whose name the flat is registered and he is empowered to sell the flat. If you are quite sure that the seller is genuine, ask him for driving licence, passport, election identity card etc. which can prove his identity. If those are also not available get his photo attested by a gazetted officer and take affidavit on stamp paper from the seller, with two attesting witnesses.

All these rules are to facilitate the matters and not to harass the genuine sellers and buyers.

Mr. Prabhakar is right in this sense, If the person do not have any ID proofs and in that circumstances, he has to make an proper affidavit in front of Magistrate by affixing a photo over affidavit.

If the seller have identification proof with different name than its registered name then can ask for affidavit to that effect.

Isn't the seller of a flat a member of the co-operative hsg society??

Doesn't the society have any proof of the seller?

The society needs to act as per the Society's rules and byelaws.

Advisable to ask for photo id proof of the buyer.
