Cheat case

(Querist) 15 June 2010 This query is : Resolved
Hello All,
My mother is having some property with her name registered in 1985, my uncle sold this land in 1992 without our notice. Can we book cheating case against my Uncle in this issue?

We already had a injunction order on this land but my uncle using some local politics and not letting us to do anything. So we want to book a cheating case on him.

Please do help me.
Thanks in advance.

Lodge a police complaint against him at the police station having jurisdiction. If they refuses to lodge (may mention that it's a civil dispute, etc...), file a Private criminal complaint u/s 200 Cr.P.C. at Judicial Magistrate Court of the area concerned.

Thank you Sir,
So we need to submit the case in the court which we booked in police station?

one more question Sir.

Can we lodge a cheating case on the person who bought the land, because he is also a part in this cheating.

Where the land is located, that police station and court jurisdiction will apply.

You can include the purchaser (mention that he has colluded with your uncle in the act of cheating).
