Querist : Anonymous (Querist) 08 February 2021 This query is : Resolved
Dear Sir

In my village I have a agriculture land (khet), some part of the land is in my uncle s( kabja)
But when my father was live it was in my (khet) and as per chakbandi naksha too it was in my (khet), but presently when I see on online naksha It is showing as parti land , and uncle is plouging on same land and it was never as parti land and presently it is in my uncle’s kabja.
My question is how I get it back from parti land to my (khet) ?

The posting furnishes no information as to the title to the land. Please post complete facts.

Whose property is this? Is it ancestral or self-acquired by your father? It is your father's own property, your mother, and your siblings if any have equal rights over the property. If it is ancestral, your uncle is also having a share in his father's (ancestral) property with other legal heirs.

Your uncle has no right, interest, claim or title over the property owned by your father, if it is self acquired.
Your father (or his LRs- after his demise) can file a suit for possession.
It would be better to consult and engage a local prudent lawyer for appreciation of facts/ documents, professional advise and necessary proceeding.
