Dear Ld.Advocates;
I have one Registered SAle Deed which was executed by my father in my name in Delhi's Registrar Office.
After about 12 years it has come to the knowledge, that the Sale Deed was registered but it was not signed by the Sub-Registrar on presentation endorsement and on acceptance of consideration by me father. On these two endorsements Sub-Registrar's signatures are not appearing, but on another page Sub-Registrar signed a REGISTERED certificate u/s 60 of R.A.1908.
Now a civil case is coming against us that Sub-Registrar's signataures were mendatory upon two endorsemnts u/s 52, 58 & 59 of R.A.1908. Registrar officetold me that now, they cannot do anything in this regards.
Please advise whether this type of Executed Sale Deeds are acceptable today or the same will be declared Null & Void by the Court.
Please Advise,
With Regards

Apply for a certified copy of that document, now the Registrar will give you the copy of the document signed in all the pages. This will be acceptable by the court.

It is a fault of the Registrar for which the deed can not be declared as null and void.
