Dear Sir,
My Wife's grand father (Calling her as Party1) has a property. Now he is no more. Party1 has all in all 6 Female children(party2). All of the female children got married after 1982. All of party2 have children again and my wife is one of them.
As of now , eldest daughter of party1 is enjoying the property.
Can you please tell me,
1) If my wife is a legal heir for the ancestral property
2) IF yes is the answer for above question, Will I and My children be also a legal heir for the above ancestral property ?
3) Can I or/and my wife give legal notice to the one who is enjoying the property all alone
Could you please help me with all the 3 questions.

1. the property is not ancestral at all.
2. wife's mother can claim it.

You have not mentioned whether your mother in law is still alive or not.
After demise of Paty1, the parties -2 became owners in possession to the extent of 1/6 share each.
After demise of mother of your wife, she shall also become owner to the extent of her share with her brothers and sisters but you or your children shall become co-sharers till the life of your wife.
