Sir, I am one of the Director of the x company, the money given to Y company and security cheque was taken from me as guarentor, now I did not sign the cheque and moreover they did not make party to the co. Whom they given the money in complaint, magistrate took cognizance u/s 138 of N.I.Act not 141, so can we file a discharge petition.
