sir, i have recieved a matter in which ABC was riding the bike of D[owner] suddenly they sleeped and the driver A was died immediatly on the spot and B who was next to him got fracture in his leg and the third one C did not recieved any injury. deceased A was license holder so does A and B entitled for the claim? because i asked some of the lawyer but they replied only B is entitle for the claim is it right? while the sitting capacity of the bike was two passanger please guide me or any authority in referece of it so please reply me.

A died due to his own mistake. if there was D in place of A then his hairs might claim for accidental benefit, A being not the owner, not entitled for claim.

Yes, only B can claim.
