Non payment of salary

Hi,

If salary is not paid more then 3 months to employee who left the company, due to any issue or in general

Whether the company needs to pay Final settlement amount to the labour welfare division (in any specific period)

whether PF & ESI needs to be paid on accural basis or on payment (salary F&F) basis

Hi,

It's not academic query, one of our client have not paid final settlement to the resigned employee for long period, i just need to know what is the consequences they need to face ?

Client has no control over the resigned employee final settlement. it's purely client process problem.
