Executer of a property

(Querist) 14 February 2012 This query is : Resolved 
An executer is appointed by court to give effect to a will.the benificieries have signed an affidavits documented by an advocate 15 years indicating taking pocession of their shares. but one party in his application for letter of administration of will has not mentioned about this.The court appoints the executer. will the excuter will take this into account or will explain if there is any difference. or what is the legal remedy to get justice.whether the decision taken by the executer can be questioned .
