selling ownership flat occupied by tresspasser

This is in a District in Maharashtra.

We own a Apartment owenership flat with all registered documents since 93.Due to old age [84] staying with relatives in mumbai for last 4 yrs. It is made known that sometime during our absence x has TRESSPASSED into the ppty.
Considering long legal hurdle & old age we thought of selling it "AS IS WHERE IS BASIS " with whatever discouted price we get. Y has shown interest,floated a Public Notice in ppr. We have briefed all facts to Y. Pl guide us in drafting a perfect Agrmnt. so as to protect our interest [legal]. whether mention of trsspasser's physical occupation needs to be included for future safty ?

if you have all legal documents then made out complaint against tress passer to the police station, they will take care.

Difficult to dislodge the possessor , your police complaint will be belated and no action will be taken. You have only option to go to civil court.

Even you declare or not any buyer will personally inspect the property.

AS you are going to sell in `as is where is condition' there will certanly be people available to buy with this condition of course at a bargained price. Writing a suitable sale deed will not be a problem. Kindly get paid consultation.
