bachelor's accomodation-reg

We are in Hyderabad and our apartment association has passed a resolution not to let the apartment for Bachelors. This is being followed since last 12 to 16 months. If any of the owners, wishes to let out his property / flat to bachelor, how much this resolution will be valid legally?

in my opinion such a resolution is not of binding nature....such kind of clauses do not amount to contract between the parties.


think practically, how can you deny a person of his civil rights? let the owner enjoy his property....in case the tenant creates some problem causing harm to the residents then you may proceed with legal action.


you may remove the concerned owner from your association but such kind of resolutions are not enforceable.

Good Morning Mr. Kiran Kumar,
Thank you very much for your reply. Extending the same issue to get further clarification, i am submitting my doubt to you.
We are 26 families staying in an apartment. By respecting the civil right of the owner of the flat, if we allow this, he can turn the apartment into a hostel, which you would appriciate would not go well with the apartment's other families maily due to the excessive floating of people, parking usage of one car and one bike would jump to one car and multiple of bike parking. Also the weekend celebrations, which definitely disturb the neighbouring people staying in the same floor. Am i right in saying that the civil right of individual flat owners are upheld, as long as he or his tennant does not spoil the freedom of others living in the apartment. If so what kind of mechanism you would suggest to us so that the same can be disucssed in our AGM and get the resolution modified.
