Executor of a Will

Dear All,

Can probate petition of a will be filed by an executor named in the will only and in case executor does not come forward for filing probate petition, under what circumstan any other person can file probate petition for the same will.

In U.P. obtaining probate is optional, what is the need to seek thereto, The will remains O.K. unless it is cancelled by competent court.
