If it is self acquired property of your father they can do nothing. For any criminal action your father may seek the help of police. Or seek the relief under THE MAINTENANCE AND WELFARE OF PARENTS AND SENIOR CITIZEN ACT 2007.

In respect of self-earned property of your father, nobody can make any claim. Therefore, your brother is only making an empty threat. If your father and mother are afraid of their good name and reputation in the society etc., he will definitely try to take advantage of it. ASK YOUR FATHER AND MOTHER TO SAY THAT IT IS HIS SELF ACQUIRED PROPERTY AND DURING HIS LIFE TIME NO ONE HAS ANY RIGHT TO CLAIM ANY SHARE OR DEMAND ANY PARTITION. IF WORST COMES TO WORST, HE WILL GIFT AWAY THE PROPERTY TO SOME MANDIR etc. etc. THEN YOUR BROTHER AND HIS WIFE WILL COME TO SENSES.

At least during the life time of the father no son or daughter can claim division of his self acquired property, as a matter of right.
