Deceased was driving the motorcycle and on the way all of a sudden he lost his control & fall down.Due to head injury he died on the spot.At the time of accident deceased was driving the bike and no other was with him at that time.M/Cycle is insured,registered owner/insured of m/cycle is friend of deceased.Police proceeded in this case under section 174 Crpc as it was a case of ITFAKIA ACCIDENT and no body is responsible for the accident.I want to file claim petition.Is my petition maintainable or not,how can i file this petition.Kindly help.Thanx

M unable to unable to understand if no one is responsible for that accident, then against whom u would file the case.

i want to add that there is provision of no fault liability under 163 A mv act,kindly also consider this aspect. Thanks
