Cognizable or non - cognizable

Please tell me that whether there is any provision of any law or any court decision which specified that Police should decide and its their responsibility to decide that particular offence is cognizable or non - cognizable in nature.

If police is to decide this then please tell specifically who is responsible to decide this means designation of a police.

It is duly decided in IPC / Cr PC, ie by ACT & LAWS.
POLICE CANNOT DECIDE [NC & COGN]

Police cannot go outside the law and be a law unto itself. Whether an offence is cognizable or not is decided by the Legislature.
