Can one become income tax practitioner having qualified u/s288 (a commerce degree) by submitting form 39.
Is there any procedural formalities there to practice in Income tax..?
Is there any provision in Service Tax..

No. Such person cannot become income tax practitioner.

Dear although section 288 is still on the statue book, yet the finance ministry has replaced ITPs with TRPs. You can now apply as Tax Return Preparer both under income tax and service tax regime. However section 288(2)(v) still provide for registration of ITP on the satisfaction and recommendation of Local AO. The certificate is issued by CIT (Admn) of the Area and on registration, one is entitled to practive income tax before any authorities upto ITAT.
Rule 51 prescribes the following qualification to become an ITP (AR)
Educational qualifications prescribed.
51. The following educational qualifications are prescribed for the purpose of clause (vi) of sub-section (2) of section 288 :—
A degree in Commerce or Law conferred by any of the following Universities:—
(I) Indian Universities :
73 Any Indian University incorporated by any law for the time being in force.
(II) Rangoon University.
(III) English and Welsh Universities :
The Universities of Birmingham, Bristol, Cambridge, Durham, Leeds, Liverpool, London, Manchester, Oxford, Reading, Sheffield and Wales.
(IV) Scottish Universities :
The Universities of Aberdeen, Edinburgh, Glasgow and St. Andrews.
(V) Irish Universities :
The Universities of Dublin (Trinity College), the Queen’s University, Belfast and the National University of Dublin.
(VI) Pakistan Universities:
Any Pakistan University incorporated by any law for the time being in force.
A commerce graduate is eligible to apply and get himself registered as ITP
