In a recent judgment by a Constitution Bench, the Supreme Court dealt with this controversy and held that a person aggrieved by a forged document, particularly a will, can file a private criminal complaint under certain relevant sections of the Indian Penal Code, and the Code of Criminal Procedure would not come in its way.

I think you are looking for a judgment where the bar imposed by IPC of taking cognizance by a Magistrate of forgery etc. committed during the proceeding before a court, where a complaint under section 340 of Cr.P.C. is provided.
the case is Iqbal Singh Marwah 2005 CriLJ 2161 which overrules Surjit singh and up held correctness of Sachidanand case.
