Under DV act a separate application has to be moved in the court u/s 23 for interim? or verbal request by the petitioner or her lawyer for interim maintenance is enough.

Some courts permit oral request. But mostly a written application is required. It is always better to file written application because it remains as part and parcel of the record and may be useful in future too.

Application under section 12 of Act already contains the prayer of interim remedy.

If someone seeks relief exparte then application along with affidavit required under section 23 (2) of the said act.

If relief already has been claimed in application, only affidavit under Sec 23(2) is required.
