Divorce

(Querist) 25 August 2020 This query is : Resolved
Hello sir, Myself and my husband wants to divorce but wants that our children doesn't get to know about it. So we won't be living separately. Divorce document with each other will ensure both of our legal freedom. How can we get it done in fastest way possible?
Quick Summary
This discussion addresses how a couple can obtain a divorce without living separately, keeping the children unaware. The recommended approach is filing a joint petition under Section 13B of the Hindu Marriage Act for dissolution based on mutual consent. While typically taking six months, the Supreme Court has allowed for this period to be waived under certain circumstances if sufficient cause is shown.

You both have to file joint petition u/a 13 B of H.M. Act for dissolution of marriage on ground of mutual consent. Generally it takes six months but as per S.C decision this six months period may be waved on explaining sufficient cause.
