(Querist) 01 January 2024 This query is : Resolved
Revision case dismissed by High court. Can applicant approach supreme court and under which section i.e to file SLP or writ petition
Sudhir Kumar, Advocate (Expert) 02 January 2024
i is only the perusal of he high court order with reference to facts of the case which can indicate the matter being fit enough to move to SLP.
T. Kalaiselvan, Advocate (Expert) 02 January 2024
The high court has dismissed the revision petition filed by the petitioner against the aggrieved orders of the trial court in an interlocutory application.
Therefore whether it is a fit case to prefer a SLP before supreme court or not agaisnt the dismissal order of high court can be opined only after perusing the papers .
You may better ask your advocate's opinion and obtain a second opinion from another expert advocate either in the local or from this forum

Case of sexual and crime against woman pending before lower court. Summons of witness were issued but witness did not appear and deputed his advocate and court accepted the same that section 91 crpc not mandate to appear personally and documents produced but witness who was to give evidence also being profile person did not appear as he known to accused and complainant filed appeal before district judge which was dismissed and even high court dismissed the same. As there is grave injustice and miscarriage of justice and witness necessary in the case can SLP be filed before supreme court
T. Kalaiselvan, Advocate (Expert) 03 January 2024
If you want to file SLP you can proceed by contacting any advocate of supreme court .
In my opinion the proposed SLP may not be entertained by apex court due to the reasons that was stated by the high court in its disposal of the appeal before it.
